1. At DEF, privacy means mutual trust and customer loyalty

When DEF started to create high quality products and services at reasonable prices, we knew that this required important partners, namely you - our customers. We work together to help you manage your digital estate in a legally compliant and secure manner. Without you, DEF could not exist.

This partnership is committed and evident in the way we handle your personal information. Just as the shopping experience at DEF is a collaborative experience, DEF is committed to protecting the customer information entrusted to us when it comes to protecting their privacy.

The protection of your personal information, hereafter referred to as "Data", is a top priority for us and is very important to us. This privacy policy is our way of showing you what data we process or collect about you, how we use the data and how you can view, change or delete it.

collected, processed and stored. DEF is therefore the "responsible body" in the sense of the Federal Data Protection Act (BDSG) and therefore legally responsible for the protection of your data. Our obligation towards you to handle your data with care.

3. If you share information with us, it will remain under the control of DEF

Your data is stored on our servers in Germany. You will find a list of our partners and providers below, in the respective chapters.

We also have data collected, stored or processed by other companies on our behalf and under our control. For example, if you place an order with a partner undertaker, which is then processed by us. Should data be processed in countries outside the European Economic Area (EEA), we will ensure that this is done exclusively in accordance with all data protection regulations.

Occasionally we pass on data to contractually associated external companies. This is only done to the extent permitted by law, e.g. so that an order placed by you can be further processed. For example, a transport company must know your name and address so that we can deliver your goods or the DEF articles you have ordered or have goods collected.

We always conclude written order processing contracts (order processing within the meaning of Art. 28 DSGVO) with all third-party companies that process your data on our behalf.

Furthermore, a law may force us to pass on data, e.g. if we receive an inquiry from a criminal prosecution authority.

We must also keep all necessary accounting data for our financial accounting and for the tax office as proof.

Otherwise we will not pass on your data to third parties without your consent.

4. For what purposes does DEF use your data?

We receive data about you when you visit our website, when you have registered with us, subscribed to our newsletter, sent a message or if you have voluntarily provided us with data. We only collect data that we need in order to process your order, your inquiry or your request as quickly as possible or to provide another service for you.

We have listed the most important purposes in the following points. If we collect additional data from you, we will inform you of this separately at the time of collection. At no time does DEF collect and process special types of personal data.

Please also note that we integrate services and content from third parties. These are for example fonts or recaptcha. Recaptcha are intended to prevent robots from entering data into our comment fields or forms and thus possibly endangering the security of the pages.

We set within our online offer on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 paragraph 1 lit. f. DSGVO), we use content or service offers from third parties in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as "content").

This always presupposes that the third-party providers of these contents are aware of the IP address of the users, as without the IP address they would not be able to send the contents to their browsers. The IP address is therefore necessary for the display of this content. We make every effort to use only such content whose respective providers use the IP address only to deliver the content. Third party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. Pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain technical information about the browser and operating system, referring websites, visiting time and other details about the use of our online offer, as well as being linked to such information from other sources.

4.1 DEF brochure

We need your name and address to send you the DEF brochures. In the event that there are any problems with the dispatch, we would also be grateful if you could also provide us with your telephone number or e-mail address. This information is voluntary and we will explicitly ask you whether we may call or e-mail you. Following the dispatch of the DEF catalogue, your data will be deleted immediately, unless there is another legal requirement.

4.2 Shopping with us

If you are shopping at DEF and delivery is arranged, whether from a partner, a branch, or when shopping at DEF's online stores, we will need your name, address, phone number and email address to ensure timely and reliable delivery and to notify you of delivery dates and/or changes in delivery.

For package deliveries, we also share your name, address, telephone number and e-mail address with our contracted contractor and service provider, DHL or Hermes, so that they can communicate with you to announce and coordinate the delivery of your ordered goods.

The above data will only be used within the scope of your purchase, i.e. to process your order, to announce the delivery, the shipping status and notification of any delivery problems, to deliver the goods, send the invoice by e-mail or by post, receive your payment and, if agreed, to provide further services.

We delete this data at the latest after the expiry of the statutory warranty period, unless applicable law obliges or entitles us to further storage or blocking of the data.

If you wish to pay for your order in the online shops of DEF - as far as possible - with your credit card, we need the data marked with an (*) as required on the payment page of the DEF website, in particular name, address, e-mail address, credit card number, name of the credit card holder and the validity period of the credit card for processing. We check the data entered together with the data of your order in order to be able to detect misuse of the credit card or the credit card payment option at an early stage and use the data after successful verification to process your payment. The data is stored by us for a maximum period of 24 months in order to be able to compare it with other credit card payments for the purpose of fraud and abuse prevention. Payment by credit card is voluntary, DEF provides you with a number of other payment options.

If you wish to pay for your order in DEF's online shops using PayPal - where possible - we will transfer the amount you are required to pay to PayPal (i.e. PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg) so that you can authorise payment to us to PayPal. Paying with PayPal is voluntary, DEF provides you with a number of other payment options.

If you want to pay for your order in DEF's online shops - as far as possible - cash on delivery, we need the data marked with an (*) as required on the payment page of the DEF website, especially name, address and way of ordering. We will forward the data to the company DHL (i.e. to DHL Paket GmbH, Sträßchensweg 10, D-53113 Bonn) or Deutsche Post (i.e. to Deutsche Post AG, Charles-de-Gaulle-Straße 20, D-53113 Bonn). The company will claim the monetary claim from you in our name.

Alternatively, we also offer payment by invoice for many products. For processing, we require the data marked with an (*) as required on the payment page of the DEF website, in particular your full name, address and method of ordering. The data is processed internally. To send the order, we pass on the data to the company DHL (i.e. to DHL Paket GmbH, Sträßchensweg 10, D-53113 Bonn) or Deutsche Post (i.e. to Deutsche Post AG, Charles-de-Gaulle-Straße 20, D-53113 Bonn). It is not excluded that we also use other service providers for transport. For example Hermes (i.e. to Hermes Europe GmbH, Essener Straße 89, 22419 Hamburg)

4.3 Your user profile at DEF

You can also use our DEF Homeshopping offers by using a profile. This profile consists of a user name and password. You can also enter the above-mentioned data (name, delivery address, etc.). Your data can be deleted on request, unless there is another legal regulation that requires us to store and process it.

Please take great care to keep your password secret to prevent misuse, and in your own interest ensure that your data is kept up to date. You are responsible for all processes that are initiated under your user name, through your fault.

The creation of a profile is purely voluntary. If you do not create a profile, please contact us in order to fulfil your wishes. However, the creation of a profile simplifies the ordering process. It only serves the purpose of making it easier for you to use our offers and to individually design and continuously improve our offers. We use your data in the profile only for the processing of orders, the provision of additional services commissioned by you and the processing of payments. You can also view your historical purchases and - if possible - call up paid services again. If you have not otherwise given us your consent to inform you about other offers, we will only communicate with you by telephone or e-mail for the purposes mentioned.

We delete your data in your profile at the latest when you delete the profile yourself or otherwise inform us that your profile is to be deleted, unless applicable law requires or entitles us to further storage.

4.4 Participation in DEF competitions, promotions, subscriptions

When you enter a DEF contest, survey or promotion, we may ask you for information that is necessary to complete the contest. This data is only stored for as long as it is necessary to carry out the competition, after which it is deleted.

4.5 Surveys from DEF

It can happen that we ask you when you use our offers which articles you prefer, why you buy this or that article or what your habits and provisions are like. We do this in order to learn more about your needs and to be able to tailor our offers even better to your requirements. This information is purely voluntary and you can use our other offers even if you do not answer these questions.

4.6 DEF Customer Service

To enable our customer service staff to respond to your questions or concerns, we need your name and a contact information (address, e-mail address and/or telephone number). This data is only used to answer your questions as thoroughly as possible. If you no longer wish to use customer service and inform us of this, we will delete your data.

4.7 DEF contact form

On our web pages we offer you the possibility to send us a message directly. To do so, please fill in the fields in the corresponding contact form on our website. In order for us to contact you, we need your full name, e-mail and/or telephone number and the reason for the request. This data is only used to answer your questions as thoroughly as possible and to fulfil your wishes. If everything is done and your wishes are fulfilled, we will delete your data.

4.8 Making an appointment

On our web pages (Appointment and Online Appointment) we offer the possibility for you to make an appointment with us directly. To do so, please fill in the fields in the corresponding contact form on our website. To enable us to contact you, we need your full name, time of contact, e-mail address and telephone number, as well as the reason for your request. This data is only used to answer your questions as thoroughly as possible and to fulfil your request for advice. If everything is done and your wishes are fulfilled, we will delete your data.

5. Information security - DEF protects your data

We have taken various organisational and technical measures to protect your data against unauthorised disclosure, unlawful use, modification and destruction. To this end, we maintain physical, electronic and procedural security measures. Our servers are secured by firewalls and virus protection. Backup and recovery as well as role and authorization concepts are a matter of course for us. In order to increase the security of your data, we always use encryption procedures (e.g. SSL/TLS for transmission over the Internet). Our employees are bound to data secrecy and must observe the regulations of the BDSG and the Telemediengesetz (TMG) when handling data.

All companies that receive data from us, regardless of whether they process data under our control or we pass on data to them, must also undertake to maintain data secrecy and to comply with certain organisational and technical data protection regulations. This is checked by DEF at the start of the contract and regularly thereafter, so that they can fulfil their obligations in practice and the protection of your data is always maintained.

6. You will not receive unsolicited advertising from DEF.

If we want to use your data to provide you with offers and information tailored to your needs, we will ask you for your express permission in advance. If you have given us your permission, you can object to the use of your data for advertising, opinion and market research purposes at any time with effect for the future. Please use the contact options provided here to object. This is the only way to ensure that we can fulfil your request 100%.

7. Cookies - those from DEF are good and "tasty"!

We use cookies on our websites. Unfortunately they are not cookies that you can eat. Web site cookies are used to make it easier for visitors to navigate the site and to simplify the registration process. Cookies are text files that are placed on your hard drive by an Internet server. A browser is part of your computer. These browsers are usually set to accept cookies automatically. Google Fonts are fonts which are provided on a server of the company Google. Thus it is possible to display a uniform Internet presence on all systems.

Wir verwenden Google reCaptcha um festzustellen, ob ein Mensch oder ein Computer eine bestimmte Eingabe in unserem Kontakt- oder Newsletter-Formular macht. We maintain online presences within social networks and platforms in order to be able to communicate with the customers, interested parties and users active there and to inform them about our services. 13. DEF stores your data only as long as necessary.

We follow the principles of data avoidance and data economy. This means that we only collect the data from you that is necessary to achieve the respective purposes and store it only as long as necessary for this purpose, as long as you have allowed us to do so or as long as the retention and storage periods provided by law require. Afterwards, your data will be blocked or deleted in accordance with the legal regulations.

15. Children

Persons under 18 years of age should not transmit personal data to us without the consent of their parents or legal guardians.

If we discover that we are processing data from children, we will delete them immediately.

16. Online presence in social media

We maintain online presences within social networks and platforms in order to be able to communicate with the customers, interested parties and users active there and to inform them about our services. When accessing the respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply.

Unless otherwise stated in our data protection declaration, we process the data of the users if they communicate with us within the social networks and platforms, e.g. write articles on our online presences or send us messages (read more in point 18).

17. Links to other websites

Our online offer contains links to other websites. We have no influence on whether their operators comply with the data protection regulations. Before we included links to other sites in our web pages, we checked whether their web pages are generally trustworthy.

However, it does happen that the websites are redesigned, renewed or supplemented. We have no influence or control over these changes. Should you notice anything that is ambiguous, offensive or incorrect, please inform us immediately.

18. Presence in the social media

We maintain appearances in the "social media". Social media include Facebook, Instagram and XING. Insofar as we have control over the processing of your data there, we ensure that the applicable data protection regulations are observed.

In its ruling in case C-210/16, the European Court of Justice decided that platform operators (here, for example, YouTube) and the operator of a channel located on the platform are jointly responsible for the data processing carried out via the respective channel.

To this extent, platform operators and channel operators are to be regarded as jointly responsible pursuant to Art 26 DSGVO.

We cooperate with these third parties with whom we are jointly responsible for the processing of personal data in accordance with Art. 26 DSGVO. These are usually platform operators of social networks or providers of web tracking tools in connection with the playout of advertising. These third parties are listed in more detail below in this section.

In these cases, we also conclude a contract with these jointly responsible parties that takes into account the requirements of Art. 26 DSGVO.

18.2 YouTube

We also use the technical platform and services of YouTube, a Google company, headquartered at Gordon House, Barrow Street, Dublin 4, Ireland. That is, if you are ordinarily resident in the European Economic Area or Switzerland, unless otherwise specified in any Additional Terms, the Services are provided to you by Google Ireland Limited ("Google"), a company incorporated and organised under the laws of Ireland.

In accordance with Google's privacy policy, we assume that any transfer of personal data, including the processing thereof, will also be made to servers of Google LLC in the United States. An adequate level of data protection for data transfers to the USA exists through the Privacy Shield Agreement between the EU and the USA and between Switzerland and the USA.

18.3 Data processed by us

Your personal data is processed for the purpose of market observation and user communication, in particular by initiating and obtaining user feedback. We process the following access data for the above-mentioned purposes:

Access source, region, age, gender, subscription status regarding YouTube channel, subscription source, playlist, device type, YouTube product, live/on demand, location of playback, operating system, subtitles, language for video information, translations used, element type, info card type, info card, where and how was shared.

The aforementioned data processing can be legitimized according to Art. 6 para. 1 letter f DSGVO our "legitimate interest". We have referred to the right of objection under Art. 21 DSGVO. Our legitimate interest lies in playing video content on YouTube with the widest possible reach. With the help of the data collected, the topics, design, length and play time of the videos can be better adapted to user behaviour.

If you, as a YouTube user, contact us directly, for example through inquiries, comments and feedback, this contact and the communication of your information is expressly on a voluntary basis and with your consent (Art. 6 para. 1 lit. a DSGVO). If necessary, we will forward your comments or reply to them or also write comments that refer to your account. The data that you freely publish and distribute on our YouTube channel will thus be included by us in our offer and made accessible to our followers and other users. In addition, we process the data that you voluntarily provide us with in the context of a personal message, if necessary to answer the message.

18.4 Data processed by YouTube

For information about what data is processed by YouTube and the purposes for which the data is used, please see the YouTube Privacy Policy. By using YouTube, your personal information is collected, transferred, stored, disclosed and used by YouTube, and transferred, stored and used in the United States and any other country in which YouTube does business, regardless of your residence.

YouTube processes the personal information you voluntarily provide, such as your name and username, email address, phone number, or the contacts in your address book when you upload or synchronize.

This so-called "log data" may include IP address, browser type, operating system, information about the previously visited website and pages you viewed, your location, your mobile operator, the device you are using (including device ID and application ID), the search terms you used, and cookie information.

In addition, for mobile devices (smartphones, tablet computers), you can restrict YouTube access to contact and calendar information, photos, location information, etc. in the settings there. However, this depends on the operating system used.

21. Right of objection

Right of objection If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. l sentence l letter f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, if there are reasons for doing so arising from your particular situation or if the objection is directed at direct marketing. The rapid development of the Internet makes it necessary to amend our privacy policy from time to time. You will be informed about the changes here. This is necessary to ensure that you always comply with the current legal requirements and to cover all our offers.
